How to buy a timeshare agreement?

Buying an assignment of a timeshare agreement from an existing leaseholder - Re-sales

Our office and the Company’s solicitors, will undertake the following administration and please note for the legal works required there is a fee due of £400 plus vat:

  • Complete your details on The Registration Form
  • After 14 Days our office will request from you a 400 plus vat payment made by cheque in favour of: ‘Blakeney Timeshare Management Ltd’.
  • On receipt of your ‘Reservation Form and £400 plus vat cheque - this is a non-refundable fee to cover the legal works required your payment will be transferred by Blakeney Timeshare Management Ltd to Shakespeare Martineau Solicitors.
  • The solicitors will prepare an assignment deed for your chosen timeshare week(s). The vendor will be asked to send back the original lease along with any other past assignments to Shakespeare Martineau.
  • The assignment deed will be sent to the vendor for their signature, who will return it.
  • The assignment deed will be sent to you for your signature and you should then return your signed assignment deed to our office along with a payment by cheque for the agreed purchase price in favour of: ‘Blakeney Timeshare Management Ltd’.
  • On receipt the office will arrange for a Company Director to sign the assignment deed and then send the completed deed along with your cheque for the purchase price back to Shakespeare Martineau Solicitors for completion.
  • The completed assignment deed and original lease will then be sent to you for your files.
  • Purchase price minus a 10% sales commission plus vat is paid to Vendor.

If you have lost your original Lease or Deed of Assignment

If you require copies of lost documents, these in most cases can be ordered directly via the solicitors retained by Blakeney Timeshare Management Ltd at a cost of £50 plus vat per document :

Procedure to buy a new lease from The Company –‘Sales’

Our office and the Company’s solicitors :
Shakespeare Martineau, Two Colton Square, Leicester, LE1 1QH.
will undertake the following administration and please note for the legal works required there is a fee due of £400 plus vat:

  • Complete your details on The Registration Form
  • Send you a Right To Cancel Prescribed Notice and Form
  • After 14 Days our office will request from you a £400 plus vat payment made by cheque in favour of: Blakeney Timeshare Management Ltd.
  • On receipt, your Reservation Form and your cheque for £400 plus vat which is a non-refundable fee to cover the legal works required and the payment will be sent to Shakespeare Martineau Solicitors.
  • The solicitors will prepare a new lease for your chosen timeshare week /s.
  • The new lease in your name will be sent to you for your signature.
  • You should then return your signed lease along with a payment for the agreed purchase price by cheque in favour of : ‘Blakeney Timeshare Management Ltd’.
  • On receipt the office will arrange for a Company Director to sign the new lease and then send the document back to Shakespeare Martineau Solicitors for completion.
  • The completed lease will then be returned to you for your files.

NOTICE OF RIGHT TO CANCEL TIMESHARE AGREEMENT GIVEN UNDER SECTION 2 OF THE TIMESHARE ACT 1992

  1. This notice refers to timeshare agreement 09776/0034/933475.DOC (1) with Blakeney Timeshare Management Limited (2) that you propose to enter into
  2. YOU HAVE UNTIL…………………(3) IN WHICH TO CHANGE YOUR MIND

At any time before or on the above date you may cancel the agreement. If you do so (unless the agreement also includes provisions for credit to help you pay for the timeshare - see paragraph 4 below) you will be able to claim back any money that you have paid under or in contemplation of the agreement. You will then have no other rights or obligations under the agreement.

  1. If your timeshare agreement includes a credit agreement
    If your timeshare agreement includes provision for credit with which to pay for the timeshare, then if you cancel the agreement as set out above, the part of it that relates to the repayment of the credit and the payment of interest will still be enforceable subject to section 7 of the Timeshare Act 1992 (see overpage). This section sets out the procedure to be followed if you wish to withdraw from the credit arrangements.
  2. If you are paying for your timeshare purchase by means of credit provided or to be provided under a separate
    timeshare credit agreement, and not under your timeshare agreement itself, you may also have a right to cancel the timeshare credit agreement. If you have, you should.
